It is important that you read the following terms and conditions before you purchase as these apply to your booking with us and to all members of your team. A copy of these Terms and Conditions are filed by us for administration purposes and you are advised to print off a copy of these conditions for your records. It is also important to understand that these Terms and Conditions apply for all purchases with us, whether you have chosen to read them or not, and are applicable for all members of your team. These conditions are available and freely accessible on our website. We also draw your attention to these Terms and Conditions during the booking process and via email and within our communications to you either in full or abbreviated or with directions and hyperlinks directing you to access them.

By purchasing a ticket and selecting the “I agree” box to the Terms and Conditions at the time of booking, you acknowledge that you understand that our Terms and Conditions apply and agree to these Terms and Conditions by continuing with a booking. The Terms and Conditions are binding when your booking is accepted and confirmed by us in writing via email, letter or fax to yourself.

Banger Italia (The Event), Czecheap Challenge (The Event) and Barcelona Bangers (The Event) are a trading name of Rally Events Ltd. Rally Events Ltd (The Organiser) is a registered company, whose company number is 6462762.

GENERAL INFORMATION

Banger Italia (The Event), Czecheap Challenge (the Event) and Barcelona Bangers (The Event) are not races. You must not compete in any manner with other participants. You must not place any bets of any kind in relation to the Event. You must drive safely and with proper courtesy to all participants and members of the public.

ENTRY FEE

The Entry Fee is due and payable within dates specified by the Organiser. Failure to pay the Entry Fee by the specified date will lead to (at the Organiser’s sole discretion) you being refused access to and participation in the Event.

DRIVING LICENCE

You must hold a current, valid and unrestricted driver’s licence if you are to drive the vehicle and you must possess a current and valid passport (together with any relevant visas). Rally Events Limited (the “Organiser”) accepts no responsibility for the consequences of you being refused passage and/or entry/exit to or from any State/Country visited en route, and in particular any additional costs incurred are you own responsibility. You must comply with all applicable laws and regulations of the Country in which you are travelling, including without limitation, all speed regulations, laws of the road, laws relating to the safety and roadworthiness of your vehicle and laws relating to the possession or use of alcohol, drugs or other prohibited substances. If you consistently or flaringly breach speed regulations and the laws of the road the Organiser reserves the right to prohibit you from participating further in the Event.

INTOXICATING SUBSTANCES

You must not consume alcohol while driving. You must not drive under the influence of alcohol or any other intoxicating substance at any time. You must not consume any illegal substances at any time during the Event. You must not drive if your ability to do so safely and properly is in any way compromised by illness, lack of adequate rest, or other condition. If the Organiser finds you under the influence of alcohol while driving or attempting to drive or under the influence of any illegal or intoxicating substances, the Organiser reserves the right to prohibit you from participating further in the Event

SAFETY

You must not drive the team vehicle if your team vehicle suffers any incident or damage which may affect its roadworthiness or if you experience any problems with any systems relating to the braking, steering, exhaustion of gasses, or cooling of the car or its engine. Furthermore you must ensure that the tyres of your vehicle meet minimum standard regulations and that they keep and maintain at least this minimum standard for the duration of the Event.

You must NOT drive if your ability to do so safely and properly is in any way compromised by illness, lack of adequate rest, or any other condition.

All participants must agree to have their cars checked by the relevant authority at any time.

You must present to the Organiser upon registration on the first day of the Event any document or certificate pertaining to the vehicle or driver of the vehicle which they may require you to provide. These will include but shall not be limited to the registration document of the vehicle, the current and valid M.O.T. certificate of the vehicle, the current receipt to show you have a valid UK tax disc for the vehicle, the current and valid insurance certificate for the vehicle and its drivers and passengers, proof of identity of the registered keeper of the vehicle and unrestricted drivers licenses for each team member who shall drive at any time during the Event.

THE NURBURGRING

The Nurburgring is a derestricted toll road but is sometimes referred to by UK insurance companies as a “prepared track”. As such, your road car insurance policy will likely not be valid and any costs incurred during your attendance on the track will be your own. There are track day policies available but it is your responsibility to investigate and decide whether you would like to purchase.

We cannot confirm at this stage whether the Nurburgring will be open for tourists to use as it does get booked for vehicle testing etc. We recommend keeping a close eye on the calendar available on their website for confirmation closer to the time. The tourist ride calendar is released in January each year for the current year.

AGE

All team members must be at least 18 years of age on the first day of the Event which they are participating in. Banger Rally specific insurance does dictate that all drivers must be over 21.

TEAMS

A team consists of at least two participants. The team captain is responsible for the organaisation of their team and all correspondents will be with the captain. Should you wish to change the captains details the current captain must contact us in writing to confirm new instructions.

In some instances it may be possible to add additional team mates to your team at a later date at a cost of £55 however this is at the organisers discretion.

RESPONSIBILITY

The Organiser accepts no responsibility for the consequences of you being refused passage and/or entry or exit to or from any state or country visited en route, and in particular any additional costs incurred are your own responsibility.

You will need to provide the following in order to participle in the Event:

– Acceptance of these Terms and Conditions;

– A fully signed version of the Event release and waiver of liability (the “Banger Italia/Czecheap Challenge/ Barcelona Bangers Waiver”);

– Confirmation of payment of the Entry Fee;

– Full insurance for your vehicle, this must include a green card permitting European travel;
This must be either using a HIC Policy using the details we have provided or with written permission from another insurance provider confirming they are happy to insure you on the event.
– Vehicle registration plates for both the front and rear of your vehicle, failure to do so may prevent access to certain EU countries;

– All drivers must carry their full driving licence ); and

– Vehicle registration documents relevant to the country of registration which must be taxed within the country of residence (where relevant).

All information that the Organiser requests from you in relation to your teams details and those of your vehicle must be accurate and complete in all material respects, and delivered in a good and orderly timescale as requested by Rally Events Ltd. Failure to provide relevant details in these time scales may void your entry to the event and you will be disqualified on the basis of holding the organisers back from completing their duties.

It is your responsibility to legally dispose of your car, or return the vehicle to the United Kingdom or the country of where it is registered. Under no circumstances should the vehicle be left abandoned during or after the Event. We will comply with all information requests from local authorities with regard to abandoned vehicles. The Organiser will not take any responsibility for your vehicle.

LIABILITY PROVISIONS

No liability for refusal of passage. The Organiser accepts no responsibility, and the Team agrees not to hold the Organiser liable, for the Team or the Vehicle being refused passage, entry or exit from any state or country visited during the Event including the Destination Country, and any additional costs and expenses incurred as a result.
Cancellation of the event. The Team acknowledges that events may happen which are beyond the control of the Organiser, and notwithstanding this fact:

Cancellation. The Organiser may cancel the Event at any time and for any reason, and in particular on the death or serious injury (to be determined at the sole discretion of the Organiser) of one of the directors, officers, trustees, agents, volunteers, representatives or employees of the Organiser.

Liability of the Organiser on cancellation. The Team agrees that the Organiser shall in no way be liable for any costs, expenses or other liabilities incurred by the Team in preparing for or participating in the Event.

The parties are not responsible if they are unable to fulfil their contractual obligations as a direct result of a fire, earthquake, epidemic disease announced by the World Health Organisation, cyclone, flood, aridity, strike, lightning, war, revolution, civil war, terrorist attack, blockade, embargo, or in any other circumstance recognised as a Force Majeure event under the laws of England.

PERSONAL ACQUISITIONS

The Entry Fee into the Event does NOT include personal acquisitions, including but not limited to, petrol (gas), telephone bills or other expenses and disbursements incurred while staying in accommodation (including courier or postal charges relating to sending left luggage with you), fines of any sort, or damage caused at any venue visited. If the Organiser is informed that damage has been caused at any venue visited, the Organiser will share information with the relevant authorities to assist them.

PERSONAL SPONSORSHIP

Personal sponsorship for your vehicle, your clothing and/or your equipment is permitted. You will be entitled to place your own sponsor’s/sponsors’ names, marks and/or logos in any position on your vehicle, clothing and/or equipment provided that your sponsor/sponsors does not/do not compete or conflict with the Event’s official sponsors or logo

The Organiser shall be entitled to determine the size and location of your sponsor’s/ sponsors’ names, marks and/or logos on your vehicle, clothing and/or equipment. If you wish to place your own sponsor’s/sponsors’ names, marks and/or logos on your vehicle, clothing and/or equipment without seeking the aforementioned consent, the Organiser reserves the right to refuse unauthorised sponsored vehicles or individuals entry to the Event

UNSUITABLE SPONSORSHIP

If you arrive at or attempt to participate in the Event with your vehicle, clothing and/or equipment displaying the branding of a sponsor that is considered by the Organiser, likely to cause offence then the Organiser reserves the right to remove such branding from your vehicle, clothing and/ or equipment. Failure to comply shall result in you and/or your team being refused access to and participation in the Event (and you/your team shall not be entitled to a refund of your Entry Fee).

INSURANCE
You shall obtain and maintain appropriate insurance covering your participation in the Event and shall provide proof of such insurance in a form satisfactory to the Organiser. Appropriate insurance includes but is not limited to, third party liability, liability cover for yourself, medical, damage to property and life insurance, In all case disclosing to the insurers that you are participating in the Event.

VIOLATION OF TERMS

If you violate any of the terms and conditions or refuse to follow the instructions given to you during the Event by the Organiser, you may be prohibited from further participation in the Event.

DISCOUNTED PRICES

The Organiser cannot be held responsible if offers specific to rally participants are, for some reason, withheld, by the party responsible for granting them. Whilst the Organiser has arranged everything that is advertised, it is possible that once on the ground some offers may be refused by those charged with granting them. The Organiser accepts no liability for this

REFUNDS (Standard Ticket)

Due to upfront costs a full refund is only available within 14 days of your initial ticket purchase(i.e. after paying any sum towards taking part in the Event inclusive of deposits) NO refunds of the Entry Fee will be made under any circumstances after this notice.

Cancellation prior to the Event. The Team may apply, in writing, to the Organiser to request that the Organiser cancels its participation in the Event up to 14 days before the Event Date. Upon written acknowledgement of, and agreement to, this cancellation request by the Organiser, this Agreement shall be terminated and the parties shall waive all claims of whatever nature in respect of this Agreement. Neither the Team, nor any of its members, shall be entitled to a refund of the Entry Fee, irrespective of the reason given for cancellation.

Cancellation during the Event. After the commencement of the Event, the Organiser shall not make any refund of the Entry Fee to the Team for any reason whatsoever.

If you are no longer able to attend the event you must inform Rally Events Ltd. immediately. Tickets may be transferable to another event within the same year at a cost of £75, this will need to be discussed with the organiser to determine if there is space on an alternative event.

REFUNDS (Cancellable Ticket)

For an additional £75, non refundable, administration fee, you have the right to cancel your team space at any time up to 4 months prior to the event, where a refund of your ticket price, excluding the administration charge, will be made.
The Team may apply, in writing, to the Organiser to request that the Organiser cancels its participation in the Event up to 4 Months before the Event start date. Upon written acknowledgement of, and agreement to, this cancellation request by the Organiser, this Agreement shall be terminated and the parties shall waive all claims of whatever nature in respect of this Agreement. The Team shall be entitled to a refund of the Entry Fee, excluding administration fee, irrespective of the reason given for cancellation.
After this date, no refunds will be issued under any circumstances and the terms return to those of a standard ticket.

Copying the Event

REFUSAL

The Organiser reserves the right to refuse participation in the Event at any time for any reason whatsoever. In case of refusal to allow you to participate, no refunds of the entry fee will be made.

IMAGE RIGHTS

By participating in the Event you consent to be photographed and to be included in the filming of footage documenting the Event. You hereby waive any and all rights of publicity or privacy and grant the Organiser full and complete permission to utilise and exploit your appearance in the Event in any and all manner and media throughout the world in perpetuity. You further agree that the Organiser has the sole discretion to use or refuse to use any photographs or footage in which you appear, and that if the Organiser does use such photographs or footage, it may be edited at the Organiser’s sole discretion. You consent to the use of your name, image, likeness, voice and biographical material about you in connection with any and all footage, publicity and related promotional material and for any and all publicity and promotional purposes. You expressly release the Organiser, its directors, officers, agents, employees, consultants, licensees and assigns from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause of action arising out of the production, distribution, broadcast or exhibition of photographs, footage or any promotional materials.

PERSONAL FILMING

You are only entitled to take photographs and film footage of your participation in the Event for non- commercial purposes (that is for personal and private use only). Specifically, you are not entitled to reproduce or use photographs or footage of the Event on any website, in any printed media or matter or in any television programme without first obtaining the prior written consent of the Organiser. You hereby agree to assign all your right, title and interest in the worldwide copyright and all intellectual property rights in such photographs or footage in perpetuity, together with exclusive worldwide rights of exploitation thereof to the Organiser, if so requested by the Organiser. You hereby grant a perpetual worldwide licence in such photographs to the Organiser. You shall deliver to the Organiser within 30 days of the end of the Event, at no cost to the Organiser, a tape in DigiBeta (PAL) or in DV (PAL) format of all the footage originated by you at the Event and copies of all photographs taken at the Event.

LOGO

You agree to have the “Banger Italia”, “Czecheap Challenge” logo or “Barcelona Bangers” logo [and official Event sponsors’ stickers] attached to your vehicle during the entire Event. You must not deface, cover-up or otherwise obscure such stickers and shall endeavour to keep them clean and visible at all times. You must do nothing to lessen the distinctiveness of the “Banger Italia”, “Czecheap Challenge” or “Barcelona Bangers” logos or which may bring either the “Banger Italia” / “Czecheap Challenge” / “Barcelona Bangers” logo or the Organiser into disrepute. Stickers are non-permanent and easily removable without damaging vehicle finishes. The Organiser will therefore not be responsible for any claims for damage to vehicle finishes as a result of the application or removal of such stickers.

BANGER ITALIA LOGO USE

The Organiser grants to you a non-exclusive, non-transferable licence to use the “Banger Italia” logos for purposes related to the Event only, and as specified in this agreement. You shall not be entitled to use the “Banger Italia” logos for any purpose whatsoever other than as specified in these Terms and Conditions without obtaining the prior written consent of the Organiser. In particular, you shall not be entitled to use the “Banger Italia” logos on any website or in printed materials without obtaining the Organiser’s prior written consent. Any goodwill that accrues from your use of the “Banger Italia” logos accrues to the Organiser.

BANGER ITALIA LOGO USE

The Organiser grants to you a non-exclusive, non-transferable licence to use the “Banger Italia” logos for purposes related to the Event only, and as specified in this agreement. You shall not be entitled to use the “Banger Italia” logos for any purpose whatsoever other than as specified in these Terms and Conditions without obtaining the prior written consent of the Organiser. In particular, you shall not be entitled to use the “Banger Italia” logos on any website or in printed materials without obtaining the Organiser’s prior written consent. Any goodwill that accrues from your use of the “Banger Italia” logos accrues to the Organiser.

CZECHEAP CHALLENGE LOGO USE

The Organiser grants to you a non-exclusive, non-transferable licence to use the “Czecheap Challenge” logos for purposes related to the Event only, and as specified in this agreement. You shall not be entitled to use the “Czecheap Challenge” logos for any purpose whatsoever other than as specified in these Terms and Conditions without obtaining the prior written consent of the Organiser. In particular, you shall not be entitled to use the “Czecheap Challenge” logos on any website or in printed materials without obtaining the Organiser’s prior written consent. Any goodwill that accrues from your use of the “Czecheap Challenge” logos accrues to the Organiser.

BARCELONA BANGERS LOGO USE

The Organiser grants to you a non-exclusive, non-transferable licence to use the “Barcelona Bangers” logos for purposes related to the Event only, and as specified in this agreement. You shall not be entitled to use the “Barcelona Bangers” logos for any purpose whatsoever other than as specified in these Terms and Conditions without obtaining the prior written consent of the Organiser. In particular, you shall not be entitled to use the “Barcelona Bangers” logos on any website or in printed materials without obtaining the Organiser’s prior written consent. Any goodwill that accrues from your use of the “Barcelona Bangers” logos accrues to the Organiser.

CHANGES TO THE EVENT

Whilst the Organisers will use its reasonable endeavours to operate all Events and arrangements as advertised and booked, by entering this contract you and your team accept that it may prove necessary or advisable to vary or modify an itinerary or its contents due to prevailing local conditions. The Organisers reserves the right at any time to cancel or change any of the facilities, services or prices, including and not limited to activities, restaurants, entertainment venues and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes.

CHANGE TO TERMS AND CONDITIONS

The Organiser reserves the right to change these terms and conditions from time to time subject to notifying you of the changes. You shall be deemed to have accepted the amended terms and conditions by participating in the Event.

ENGLISH LAW

These terms and conditions and your participation in the Event are governed by English law, and you submit to the jurisdiction of the Courts of England.

RISKS

Risks associated with taking part in the Event. I acknowledge and realise that participation in an event such as Banger Italia, Czecheap Challenge and Barcelona Bangers (the “Event”) is potentially dangerous and that there are numerous risks associated with my participation. Such risks and dangers include, but are not limited to, traffic accidents, collisions with pedestrians, vehicles, other drivers, and/or fixed or moving objects, and the negligence of other drivers. Further, I fully understand and realise that my participation in the Event may result in serious bodily injury and/or death to myself or others. I further realise and understand that the route of the Event will require driving on public roadways upon which the hazards of travelling are to be expected. Further, I realise that participation in the Event will require strenuous physical exertion as participants will be required to drive for very long periods of time over several days, including the risk of driving through inclement weather.

Assumption of the Risks. With full knowledge and understanding of the risks associated with my participation in the Event, I enter the Event voluntarily and fully accept and assume every such risk for loss, damage, or injury (including death).

ORGANISERS DISCLAIMER

Rally Events Limited (the “Organiser”) declines liability in any accident caused by or to the participants and their vehicles during the whole of the Event. The Organiser declines any liability for any breach of the laws and regulations of any country detailed in its itinerary. Participants shall be held responsible for any accident or breach of the laws in which they may be involved and shall declare to the Organiser particulars of any such accident from which liability may arise and shall have no claim against the Organiser arising out of any act or omission of the Organiser, its officers, directors, employees, consultants, agents or event sponsors during the course of the Event.

COMPLIANCE

Compliance with the Rules and the Terms and Conditions of Entry. I agree to comply with all the Event’s rules and terms and conditions of entry. I acknowledge and understand that the Organiser of the Event will use reasonable efforts to ensure that all other participants abide by the terms and conditions of entry, but cannot guarantee that the participants will abide by these terms and conditions.

INDEMNITY

I hereby agree to release, defend, indemnify, and hold harmless the Organiser, its officers, directors, employees, consultants, agents, Event sponsors and licensees and assigns from and against any and all claims, demands, damages, suits, liabilities or actions arising directly or indirectly out of my actions or otherwise from my participation in the Event whether made or claimed during or after the Event, including all associated costs and expenses and any amounts which the Organiser may pay as a settlement or compromise of any such claims or liabilities. no cars allowed with modified cut off roofs. Maximum 6 persons per team.

WAIVERS

Waiver by participants. In consideration for being permitted to participate in the Event, I hereby waive, release, and forever discharge, for myself, my heirs, executors, administrators and legal representatives, any and all rights and/or claims which I have, may have, or may hereafter accrue to me against the Organiser, its officers, directors, employees, consultants, agents and/or event sponsors for any and all damages, injuries (including death), and/or claims which may be sustained by me directly or indirectly arising out of my participation in the Event (including the application of emergency or medical services at the Event) even if the damages, injuries (including death), and/or claims are caused by the negligence of those persons listed above or otherwise save that nothing in these Terms and Conditions shall be constructed as excluding or limiting the Organiser’s liability for personal injury or death arising from its negligence or the negligence of persons under its control. Further, I covenant not to sue the Organiser, its officers, directors, employees, consultants, agents or Event sponsors for any and all damages, injuries (including death), and/or claims which may be sustained by me directly or indirectly arising out of my participation in the Event. This release and discharge includes, but is not limited to, claims for personal injury, death, property damage, economic loss, breach of contract, lost wages, contribution indemnity, indemnity, punitive damages, negligence, or any other legally recognisable claim arising out of my participation in the Event (including all legal costs associated with such claims).

I have read this waiver, fully understand its terms, and understand that I have given up substantial rights by signing it. I have done so freely and without inducement, coercion, or duress. I intend this waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that, if any portion of this waiver is held to be invalid, that the balance of the waiver shall continue in full force and effect.

Please note that by completing this application you are concluding a legally binding agreement with Rally Events Limited to participate in the Event and are bound by these terms and conditions. no refunds available after registration.
